General conditions for the use of intellectual creations
The purpose of these conditions is the transparent and clear regulation of the rights and obligations of the contracting parties and of the legal relations of use related to Creation, between the author (hereinafter the ’’Author’’) of the e-learning teaching material (hereinafter the "Creation") uploaded on the portal edumodul.hu created by the Rejtett Kincsek Down Egyesület Association (hereinafter: "Association") in the project entitled "Development with online support for children with different abilities", funded under the Erasmus + program, respectively the owner and operator of the portal edumodul.hu , Association.

General conditions of use of intellectual creations:
1. The author can upload Creation on the edumodul.hu portal only after prior registration.
2. During the registration the Author will provide the following data: name, surname, e-mail address, password, presentation, languages spoken (English, Hungarian, Romanian, Slovakian). During the registration the author has the possibility to register on the newsletter of the Association, respectively to give his consent for his name to appear among the names of the specialists presented on the registration platform of the portal edumodul.hu.
3. The author has the right to correct on the registration platform any errors in the data provided by him during the registration, before formulating the declaratory legal act.
4. The author acknowledges as a result of the registration that the Association has made it possible for him to know before concluding this contract the content of these Conditions and that he accepts them as binding on him.
5. The declaratory legal act transmitted by the Author electronically, enters into force when it becomes accessible to the Association. The contract is concluded between the Parties, when the confirmation sent by the Association, provided with the registration number of the contract according to point 6., becomes accessible to the Author.
6. The author acknowledges that the contract to be concluded under these conditions is considered a written contract in accordance with art. 45, paragraph (3) of law no. LXXVI of 1999 on copyright. The Association will register the use contract together with the registration of the Author, the registered contract being accessible later.
7. By uploading the Creation on the edumodul.hu. Portal, the Author authorizes the Association without the need for other declarations, to use without territorial restrictions, regarding the duration of use or mode of use, the Creation made and uploaded by the Author on the edumodul.hu. Portal, respectively allows the Association to authorize the use of the Creation by a third party. The Association has the right, according to the contents of this point, to process, multiply and promote without restrictions the Creation made by the Author.
8. According to these Conditions, the Author does not claim any remuneration for the use of the Creation, he expressly waives the compensations regarding the copyright, thus supporting the fulfillment of the objectives established in the Statute of the Association.
9. The author has the right to be indicated as author on Creation, respectively in the publication related to Creation, depending on the size and nature of the publication. The author must also be mentioned in the case of taking over, quoting or presenting a fragment of Creation.
10. By uploading the Creation on the edumodul.hu portal, the Author guarantees that no third party has any rights over the Creation, which could prevent, exclude and / or limit the acquisition of the right according to point 7., respectively the right to use the Association. The author guarantees that the Creation created and uploaded by him is unencumbered, free of claims and does not constitute the object of any civil action, respectively that it does not affect the copyright, personal rights, patents, trademark or other rights of any third party.
11. The Author acknowledges that the Association has the right to immediately delete the Creation already uploaded on the portal edumodul.hu, if the Author has made accessible data content that violates good morals or legal provisions, in particular copyright or personal rights.
12. Those contained in point 7. shall remain in force until the expiry of the term of copyright protection. The author is obliged to conclude with collaborators, employees, persons with whom he is in legal employment or other relations, with persons in his sphere of interests (hereinafter: collaborators) contracts, which ensure the unrestricted acquisition by the Association of the rights set out in point 7. The author is obliged to conclude contracts with all collaborators according to the content in this point, and exclusively the author is obliged to make settlements with collaborators related to the performance of contracts. The Author will be liable exclusively, if any collaborator and / or third party, for any reason, validates claims related to Creation towards the Association, the Author being obliged to immediately and totally exonerate the Association. The author acknowledges - whether or not the Association has deleted the Creation from the page - that he will be liable for all legal consequences resulting from any violation of copyright or other rights, and undertakes to pay all damages caused by the violation of these respectively, undertakes to pay directly all claims claimed from the Association regarding the infringement of copyright or other rights, as well as the value of the fines imposed.
13. The Association acquires a transferable right of use to a third party, without territorial restrictions, regarding the duration of use, use or other restrictions, only on the Creation according to point 7. Moreover, the Author retains the right to use those contained in the teaching material. e-learning.
14. The parties declare that they have concluded the contract with due diligence, assuming the risk of possible error, and therefore have no right to challenge the declaratory legal act as an error. The parties exclude the possibility of attacking the contract as an obvious value disproportion.
15. In the event of a dispute, the parties recognize the exclusive jurisdiction of the Court of Nyíregyháza.
16. The contract is concluded in Hungarian. With regard to matters not regulated by these conditions, the legal provisions in force in Hungary are applicable, in particular the provisions of Law no. LXXVI of 1999 on copyright.
17. The Association has the right to modify these Conditions unilaterally at any time. These Conditions and any changes thereto will be published by the Association on the website www.edumodul.hu/hu/aszf. These Conditions and their modifications enter into force on the day following their appearance on the page www.edumodul.hu/hu/aszf. The amendments are applicable to contracts concluded after the entry into force of those amendments.
